These Terms of Service ("Terms") form a binding agreement between you and Austin InHouse Test Prep, LLC(a Texas-registered limited liability company doing business as "InHouse Test Prep," operated remotely from Hawaii; "we," "us," "our"), and govern your use of the scheduling portal at inhousetestprep.com(the "Service") and any tutoring services delivered through it.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service is a private scheduling and client management portal that supports Dr. Kelly Frindell's one-on-one test preparation tutoring practice. Accounts on the Service are created by invitation only — there is no public signup.
2. Accounts
- Eligibility. You must be at least 18 years old to be a primary account holder. Students 13 and older may be granted portal access by their parent or guardian. The Service does not create accounts for children under 13.
- Accuracy. You agree to provide accurate information when you create your account and to keep it up to date.
- Security. You are responsible for keeping your password confidential and for everything done through your account. Notify us at info@inhousetestprep.com immediately if you believe your account has been compromised.
- Two-factor authentication is required for the administrator account. Other roles may opt in.
3. Tutoring services
The Service is the scheduling and billing layer for in-person and remote tutoring sessions with Dr. Kelly Frindell. The tutoring itself is governed by your separate engagement letter or service agreement with Dr. Kelly. To the extent the engagement letter and these Terms conflict regarding tutoring services, the engagement letter controls.
4. Packages, sessions, and balances
- Packages. When you purchase a package, your family account is credited with the corresponding number of sessions.
- Single sessions. Individual sessions may be purchased outside of a package.
- Shared balance. Each family has one shared package balance from which all enrolled students may draw.
- Session consumption. A session is consumed at the scheduled start time, regardless of whether the student attends, unless cancelled or rescheduled in advance under §5.
- No refunds for unused sessions. Sessions purchased as part of a package are non-refundable except as required by applicable law, but unused sessions do not expire while your account is active.
5. Cancellation and rescheduling policy
- More than 24 hours before start time. You may cancel or reschedule online through your portal at no charge. Your session credit returns to your balance.
- Within 12 hours of start time.Online cancellation and rescheduling are not available. Contact Dr. Kelly directly. At Dr. Kelly's sole discretion she may waive the late charge.
- Dr. Kelly-initiated cancellations. If Dr. Kelly cancels a session for any reason, the session credit is returned to your balance.
- Missed sessions (no-shows) are treated as consumed sessions. Dr. Kelly may, at her discretion, restore the credit on a case-by-case basis.
The 12-hour rule exists so Dr. Kelly's time is treated with the same respect every family expects from a professional service. Repeated late cancellations may, at Dr. Kelly's discretion, result in changes to your engagement.
6. Payments
- Payment processor. Payments are processed by Stripe, Inc. under Stripe's terms. We do not store full credit card numbers.
- Authorized charges. By providing a payment method, you authorize us to charge it for packages and single sessions you have purchased. You will see a clear preview of every charge before it occurs.
- Failed payments. If a payment fails, your access to scheduling may be paused until payment is resolved. We will email you when a payment fails.
- Taxes. You are responsible for any sales or use tax that applies to your purchases.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to access another family's data or any data you are not authorized to see.
- Disrupt, overload, or interfere with the Service.
- Reverse engineer or attempt to extract source code.
- Use the Service to harass, abuse, or threaten Dr. Kelly or anyone else.
- Share your account credentials with anyone outside your family.
Violation of this section may result in termination of your account without refund.
8. Communications
By creating an account, you agree to receive transactional communications from us — session reminders, booking confirmations, billing receipts, password resets, and similar messages — by email, SMS, or in-app messaging. These are required for the Service to work.
SMS program (Appointment Reminders & Account Notifications). By providing your mobile number and opting in via the SMS consent checkbox during family signup (or by updating your notification preferences in your account), you agree to receive SMS messages from InHouse Test Prep, including appointment reminders, booking confirmations, cancellation and reschedule notices, waitlist openings, and similar account notifications. Message frequency varies based on your scheduling activity and typically ranges from 2 to 8 messages per month per enrolled student. Message and data rates may apply.
Reply STOP to any SMS from us to unsubscribe; you will receive a single confirmation and no further SMS unless you re-enroll through your account. Reply HELP to any SMS for support information, or contact us anytime at info@inhousetestprep.com. Carriers are not liable for delayed or undelivered messages.
You may also opt out of non-transactional communications at any time from your account settings.
9. Intellectual property
The Service, its design, content, and underlying software are owned by InHouse Test Prep and protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable license to use the Service for the purposes described in these Terms. You retain ownership of content you upload (e.g., score reports), and you grant us a limited license to store and display that content within the Service to provide it back to you and to Dr. Kelly.
10. Privacy
Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference.
11. Termination
You may close your account at any time by emailing info@inhousetestprep.com.
We may suspend or terminate your account if you violate these Terms, if your payment method fails repeatedly, or if your tutoring engagement with Dr. Kelly ends. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, dispute resolution) survive termination.
12. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
Tutoring services may improve a student's preparation for standardized tests, but we make no guarantee of any specific score outcome. Test results depend on many factors outside our control.
13. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim related to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages.
Some jurisdictions do not allow some of the limitations above. To the extent your jurisdiction does not allow them, they do not apply to you.
14. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms, your misuse of the Service, or your violation of another person's rights.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Service will be resolved in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.
16. Changes
We may update these Terms from time to time. If we make material changes, we will notify you by email and update the effective date at the top of this page.
